Neste final de semana, esta Folha publicou editorial criticando a proposta de ampliar a pena daqueles que assassinam mulheres por “razões de gênero”. O texto alega que tal “populismo” jurídico seria extravagância, já que todas as circunstâncias agravantes que poderiam particularizar o homicídio contra mulheres (motivo fútil, crueldade, dificuldade de defesa) estariam contempladas pela legislação vigente. Neste sentido, criar a categoria jurídica “razões de gênero” de nada serviria, a não ser quebrar o quadro universalista que deveria ser o fundamento da lei.
No entanto, é difícil concordar com o argumento geral. Primeiro porque não é correta a ideia de que dispositivos jurídicos que particularizam a violência de grupos historicamente vulneráveis sejam eficazes. A Lei Maria da Penha, só para ficar em um exemplo, mostra o contrário. Pois, ao particularizar, o direito dá visibilidade a algo que a sociedade teima em não reconhecer. Ele indica a especificidade para um tipo de violência que só pode ser combatido quando nomeado. Neste contexto, apagar o nome é uma forma brutal de perpetuação da violência.
Estudo do Ipea1 estima anualmente, no Brasil, algo em torno de 527 mil tentativas e casos de estupros, sendo que 88,5% das vítimas são mulheres e mais da metade tem menos de 13 anos. Só em 2011, foram notificados no Sinan2 33 casos de estupro por dia, ou seja, esse foi o número de vítimas que procuraram o serviço médico. Diante de números aterradores, é difícil não reconhecer que existe uma violência específica contra as mulheres, assim como há específicas contra homossexuais, travestis entre outros. Que o direito sirva-se de sua capacidade de particularizar sofrimentos para lutar contra tais especificidades, eis uma de suas funções mais decisivas em sociedades em luta para criar um conceito substantivo de democracia.
Nesse sentido, há de se lembrar que não se justifica usar o argumento da necessidade de respeitar a natureza universalista da lei em situações sociais nas quais tal universalidade mascara desigualdades reais. O direito deve usar, de forma estratégica e provisória, a particularização a fim de evidenciar o vínculo entre violência e certas formas de identidade, impulsionando com isto a criação de um universalismo real.
Se a sociedade brasileira chegou a este estágio de violência contra a mulher é porque há coisas que ela nunca quis ver e continuará não vendo enquanto o direito não nomeá-las. Quando tal violência passar, podemos voltar ao quadro legal generalista. Desta forma, ao menos desta vez, o governo agiu de maneira correta.

– organising an observation service, prevention and alarm (security) service at local and regional levels;
– implementing legislation regulating the use of fire by all the population present in or at the edge of forests, and more particularly by owners and individuals exercising a professional activity in sensitive areas;
– planning and concrete preparation (periodic maintenance) for fire-fighting through adequate landscaping of the territory and appropriate forest cultivation limiting fire propagation (alternating vegetation, clearance, trimming), creating and maintaining access paths (extinction) and fire-break areas as well as fire-fighting equipment such as water supplies (conduits, cisterns), watch towers and meteorological posts, and the construction of helicopter landing pads;
– surveillance and detection of fires as soon as the danger of fires is forecast by the ad hoc meteorological service (which comprises automatic or mobile statistics posts observing the winds and the vegetation: dryness, force, direction, evolution);

– preparation and concretisation (organisation) of an intervention mechanism: this requires the setting up of specialised management programmes ensuring the coordination of powerful and efficient equipment and means for fighting forest fires (instruction);
– preparedness management and the coordination of the use of the means of intervention of the authorities and the information and alarm services for the population require a secure transmission network (radio network);

O Ibama deu sinal verde para os trabalhos de esterilização das capivaras que vivem no entorno da Lagoa da Pampulha, um dos principais cartões-postais de Belo Horizonte. No início da semana, técnicos da Secretaria Municipal de Meio Ambiente começaram a fazer o trabalho de dedetização da área externa, capina e limpeza de contêineres onde serão realizadas as cirurgias nos animais. As medidas estão sendo tomadas depois da morte de um homem de 42 anos, vítima de febre maculosa – doença transmitida pelo carrapato-estrela. Moradores comemoram o início dos trabalhos após ficarem apreensivos com a volta da doença.
