A criação de agências reguladoras é resultado direto do
processo de retirada do Estado da economia. As agências foram
criadas com o objetivo de normatizar os setores dos serviços
públicos delegados e de buscar equilíbrio e harmonia entre
Estado, usuários e delegatários. Na Alemanha, esse novo conceito
é chamado de economia social de mercado, pois, se há uma
regulação, não é o liberalismo puro. Também não é correto
afirmar que esse modelo se aproxima dos conceitos socialistas,
pois há concorrência entre a iniciativa privada na prestação de
serviços. A idéia é a de um capitalismo regulado, que visa evitar
crises, um modo de interferência do Estado na economia.

A noção de agência reguladora, como instituição resultante

como substancialidade imediata do espírito, pode apresentar-se em
uma roupagem de viés corporativo totalizante, como espaço que
encarne uma facção de interessados - daí o fenômeno conhecido
por captura do órgão regulador, em que há a contaminação do
espaço público pelos interesses particulares de quaisquer dos
partícipes como fins -, ou pode firmar-se na posição a ela
designada de espaço de suspensão de particularidades
do governo, do Congresso, da sociedade civil, dos usuários, das empresas,
em nome de uma persona destinada a ser parte de um projeto maior de

 base, which has been growing at historic rates of 30% a
 19 year and now serves over 50 million customers. In other
 words, four out of every ten Brazilians have a cellular

 surpassed that of the traditional fixed telephone system,
 because the cell phone actually fulfills the function of
 25 taking communication to all levels of the population. Its
 widespread network has opened gateways to regions that
 formerly had not been benefited by the implementation of
 28 a fixed telephone system, such as, for example, many rural
 areas that are now mobile telephone customers.
              The responsibility that cellular telephony carries
 31 as an instrument for transforming people's lives tends to
 increase enormously in the short term. In Brazil, third

 34 is able to provide handheld resources, similar to CD, DVD
